Senator Ted Budd (R-NC) has joined a letter to President Biden expressing concerns about the Administration's decision to elevate Acting Secretary of Labor Julie Su into the presidential line of succession. The letter, led by Senators Katie Britt (R-AL) and signed by a total of 30 senators, questions the eligibility of Su to assume the office of the President of the United States.
The letter highlights the fact that Su's nomination as Secretary of Labor has not been confirmed by the United States Senate since March 14, 2023. Despite lacking support from both Republican and Democratic members of the Senate, Su has been kept in place as Acting Secretary of Labor indefinitely. The White House has also listed her on the website as a member of the Cabinet "[i]n order of succession to the Presidency."
The senators argue that this decision goes against congressional intent and may violate the law. They point out that the Presidential Succession Act of 1947, passed by Congress, establishes the current presidential line of succession. According to the act, Cabinet members can assume the office of the President only if they are "appointed, by and with the advice and consent of the Senate." Since Su has not been appointed in this manner, the senators urge the White House to clarify its position on her eligibility for the presidential line of succession.
The letter emphasizes the importance of upholding the Constitution and the principles of governance on which the Republic rests. It states, "It is unimaginable to think that this Administration believes someone who has neither been duly elected nor confirmed by the Senate to the position of Secretary of Labor could be President of the United States."
In addition to questioning Su's eligibility, the senators call upon President Biden to withdraw Su's nomination and put forward a nominee for Secretary of Labor who can garner bipartisan support for confirmation.
The letter serves as a strong statement from Senator Budd and his colleagues, expressing their concerns about the decision to place an unconfirmed nominee in the presidential line of succession. It remains to be seen how the White House will respond to their request for clarification.
