Rouzer Votes to End Unconstitutional Pistol Brace Rule

WASHINGTON, DC - On June 13 , with the support of Congressman David Rouzer (NC-07), an original cosponsor of the legislation, the House of Representatives passed H.J. Res. 44.  This legislation would block the Biden Administration’s unconstitutional pistol brace rule and protect Americans’ Second Amendment rights.

"The Biden Administration's unconstitutional pistol brace rule infringes on the Second Amendment rights of millions of law-abiding gun owners, including many disabled combat veterans," said Rouzer.  "I'm proud to support the effort to overturn this rule and will continue fighting to protect Americans' fundamental right to bear arms."

Background:

Under the Biden Administration's Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rule, titled Factoring Criteria for Firearms with Attached Stabilizing Braces, pistols with a stabilizing brace attachment would be reclassified as short-barreled rifles, and gun owners who fail to register their pistols with stabilizing braces with the ATF could face 10 years in jail and fines up to $10,000.  Stabilizing braces were first designed and intended to help disabled veterans fire large-format pistols.  For years, ATF recognized their legitimate function.  Now, under this rule, many disabled individuals have lost the ability to use these firearms.

If gun owners do not register their firearms, they would have to destroy the firearm, surrender their firearm to the ATF, or remove the brace in such a way it cannot be reattached.
